How is child support calculated in Australia?

Child support is calculated by Services Australia using a formula that considers both parents’ incomes, how much time the child spends with each parent, and the cost of raising children at different ages.

Do I have to go through Services Australia for child support?

No. Parents can create their own private agreement if they both agree. These can be informal, or formalised through a Limited or Binding Child Support Agreement.

What’s the difference between a Binding and Limited Child Support Agreement?

A Binding Agreement requires legal advice and is more difficult to change. A Limited Agreement is easier to end but requires a child support assessment.

What happens if my ex doesn’t pay child support?

Services Australia can take action like garnishing wages, intercepting tax refunds, or suspending passports. You can also seek legal advice to pursue unpaid support.

Can we change our child support agreement later?

Yes. Child support agreements can be reviewed or terminated if circumstances change, but the rules depend on whether you have a Binding or Limited Agreement.

Is child support separate from spousal maintenance?

Yes. Child support is for the child’s needs. Spousal maintenance is financial support for a former partner who cannot support themselves adequately.

Not automatically. The basic assessment doesn’t include private school fees, medical costs, or extra-curricular expenses — unless agreed to in a private child support agreement.

How long do I have to pay child support in Australia?

Child support usually continues until the child turns 18 or finishes secondary school — whichever is later.
