What is family dispute resolution (FDR)?

Family dispute resolution is a form of mediation that helps separated couples resolve parenting or financial issues without going to court. It’s often a required first step before applying to the Family Court.

Is mediation compulsory before going to court?

In most parenting matters, yes. The Family Law Act requires parties to attempt FDR before applying to court, unless there’s a risk of family violence or urgency.

What’s the difference between mediation and arbitration?

Mediation involves a neutral third party helping you reach an agreement. Arbitration is more like a private court process — an arbitrator hears evidence and makes a binding decision.

Do I need a lawyer during mediation?

While not mandatory, having a lawyer involved can help you understand your rights, prepare effectively, and avoid making agreements that don’t serve your interests.

Is a mediated agreement legally binding?

Only if it’s formalised. Verbal or informal written agreements aren’t enforceable. You can turn a mediated outcome into a legally binding Consent Order or a Binding Financial Agreement.

What if we can’t reach an agreement in mediation?

If mediation fails, you can request a Section 60I Certificate, which allows you to proceed to court. In some cases, other pathways like arbitration or collaborative practice may be better suited.
